The Legal Basics: What You’ll Need
1 Valid U.S. Passports
Your passport is your golden ticket. Make sure it’s up to date and matches the name on all your paperwork.
2 Birth Certificates Birth Certificate Original + copy translation into Italian. These must be authenticated with an Apostille stamp from your state’s Secretary of State.
3 Proof of Freedom to Marry
This comes in two parts:
* Atto Notorio as a proof of no legal impediment to marry to be done in U.S. at the Italian Consulate (by appointment only). It can be done in Italy as well at the Law Court with extra price for the interpreter, witnesses and stamps.
* Affidavit ( Nulla Osta) to be done in Italy at the local U.S. Consulate ( by appointment only) and legalized in the Prefettura.
4 Divorce or Death Certificates (If Applicable)
If you’ve been married before, bring proof of its end—divorce decrees or death certificates—also with Apostille stamps and translated into Italian.
The Process: Step-by-Step
Here’s how it flows:
• Book Early: Begin planning your legal ceremony 6-9 months before.
• In Italy: Arrive a few days early. We will book an appointment at the U.S Consulate to get your Nulla Osta ( Affidavit – so the Permission to get married in Italy), then legalize it at the local Prefettura.
• Town Hall Visit. We will go together. Different towns may have slightly different procedures, which is why having a local expert is highly recommended.
• The Big Day: Your civil ceremony, led by a mayor or official, can happen in a stunning approved venue—think grand villas or medieval halls. Two witnesses and an interpreter seal the deal.
• Post-Wedding: You will get your marriage certificate apostilled and it’s valid in the U.S.!
